These Terms of Service (“Terms”) govern your access to and use of HaloIQ (the “Service”), operated by HaloIQ (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
HaloIQ analyzes property and portfolio data you provide and combines it with third-party benchmarks and market data to produce efficiency scores, opportunity estimates, and AI-generated narratives. All outputs are estimates derived from models and assumptions, may contain errors, and are not guaranteed to be accurate, complete, or current.
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and legally able to enter into these Terms. Notify us promptly of any unauthorized use.
We will send you transactional messages needed to operate your account. Marketing emails (product updates and launch news) are optional and sent only if you opt in; you can change your marketing preference or unsubscribe at any time in your account settings. Our Privacy Policy explains how we handle your data.
Free accounts include a limited number of analyses per month. Paid plans (Starter, Pro, Enterprise) are billed through our payment processor, Stripe. Usage limits reset monthly. Enterprise plan pricing is usage-based and arranged directly with us.
Auto-renewal: paid subscriptions automatically renew at the end of each billing period — monthly plans renew each month, and annual plans renew each year and are charged in full at the start of each annual period — at the then-current price for your plan, until you cancel. Founder-rate subscriptions renew at the locked founder price for as long as the subscription remains active.
Cancellation: you can cancel anytime online through the billing portal in your account — no call or email required. Cancellation takes effect at the end of the current billing period, and you keep access until then. Fees already paid are non-refundable except where required by law.
The Service may allow you to invite others to view a specific portfolio in read-only mode. If you invite someone, you represent that you have the right to share that data with them. Invited viewers receive access only to the specific portfolio shared with them and may not modify it.
You agree not to: (a) use the Service to violate any law; (b) reverse engineer, scrape, or resell the Service except as expressly permitted; (c) attempt to gain unauthorized access to systems or other users’ data; (d) upload content you do not have the right to use; or (e) use outputs as the sole basis for a financial decision affecting third parties without independent professional review.
You retain ownership of the property and portfolio data you submit. You grant us a license to process it to operate and improve the Service, as described in our Privacy Policy. This license does not permit us to use your data to train AI models. You are responsible for the accuracy and legality of the data you provide.
The Service incorporates data from third parties including the U.S. Department of Energy / EIA, Freddie Mac, Rentcast.io, and Anthropic. We do not warrant the accuracy of third-party data and are not responsible for it. Such data is subject to its providers’ terms.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS ARE ACCURATE OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HALOIQ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR INVESTMENT LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the dispute informally for 30 days.
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
